MPCB Compliance
01 . MPCB Compliance :

The Maharashtra Pollution Control Board (MPCB) is responsible for enforcing environmental regulations in the state of Maharashtra, India. To ensure compliance with MPCB regulations, organizations must follow the guidelines and standards set forth by the board. The following are some key areas of compliance that organizations operating in Maharashtra must be aware of:
Importance of MPCB Compliances:
- 1] Air Pollution Control: Organizations must comply with the standards set by MPCB for air emissions from industrial processes and vehicles.
- 2] Water Pollution Control: Organizations must comply with MPCB's standards for discharge of wastewater into the environment, and for the treatment of industrial effluent.
- 3] Hazardous Waste Management: Organizations must comply with MPCB regulations for the safe handling, storage, and disposal of hazardous waste.
- 4] Noise Pollution Control: Organizations must comply with MPCB standards for noise levels in industrial and residential areas.
- 5] Environmental Impact Assessment: Organizations must complete an Environmental Impact Assessment (EIA) prior to starting any new project, to ensure that the project will not have a negative impact on the environment.
1.1 Consent to Establishment:
Consent to Establishment (CTE) is a permission granted by the pollution control board to set up and operate an industrial unit in a specific location. The purpose of CTE is to ensure that industrial units operate in an environmentally responsible manner, and comply with all relevant environmental regulations.
Once the application is received, the pollution control board will conduct an inspection of the site, and review the documents submitted. If the board is satisfied that the proposed project will not have a significant impact on the environment, it will grant CTE.
It is important to note that CTE is a time-bound permission, and organizations must renew their CTE periodically, as per the board’s regulations. Organizations must also comply with all conditions specified in the CTE, and take necessary steps to mitigate any negative impact on the environment. Failure to comply with the conditions of CTE can result in fines, legal action, and suspension of operations.
1.2 Consent to Operate :
Consent to Operate (CTO) is a permission granted by the pollution control board to operate an industrial unit, once it has been established. The purpose of CTO is to ensure that industrial units operate in an environmentally responsible manner, and comply with all relevant environmental regulations.
1.3 Consent to Operate Renewal :
Consent to Operate (CTO) Renewal is the process of renewing the permission granted by the pollution control board to operate an industrial unit. The purpose of CTO renewal is to ensure that industrial units continue to operate in an environmentally responsible manner, and comply with all relevant environmental regulations.
Once the application is received, the pollution control board will conduct an inspection of the site, and review the documents submitted. If the board is satisfied that the organization is in compliance with the conditions specified in the original CTO, it will renew the CTO.
It is important to note that CTO renewal must be completed before the expiration of the original CTO, to ensure that the industrial unit can continue to operate without interruption. Organizations must also comply with all conditions specified in the renewed CTO, and take necessary steps to mitigate any negative impact on the environment. Failure to comply with the conditions of CTO can result in fines, legal action, and suspension of operations.
1.4 Monthly & Annual Returns:
Monthly and Annual Returns are periodic reports submitted by industrial units to the pollution control board, to provide information on their operations and compliance with environmental regulations. The purpose of these returns is to ensure that industrial units are operating in an environmentally responsible manner, and to monitor their impact on the environment.
Monthly Returns are typically submitted on a monthly basis, while Annual Returns are submitted once a year. Organizations must ensure that the information provided in these returns is accurate and up-to-date, and that they comply with all conditions specified in their CTO. Failure to submit returns, or to provide accurate information, can result in fines, legal action, and suspension of operations.
